Terms of Service

By creating an account, using any feature of ArcticFlow, or continuing to use the App after updates to these Terms, you confirm that:

• –You are at least 18 years old, or are using the App under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
• –You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
• –You have the legal capacity to enter into this agreement.

These Terms constitute a legally binding agreement between you and Arctic Flow AI Limited.

• –ArcticFlow does not diagnose, treat, cure, or prevent any disease or medical condition.
• –The AI assistant provides general health information only. AI responses are not a substitute for professional medical judgement, diagnosis, or treatment.
• –Always consult a qualified healthcare provider before making decisions about your health, medications, or treatment plans.
• –In the event of a medical emergency, call your local emergency services immediately (e.g., 999 in the UK, 911 in the US, 112 in the EU). Do not rely on ArcticFlow in an emergency.
• –Arctic Flow AI Limited accepts no liability for decisions made based on information provided by ArcticFlow or its AI assistant.
• –Regulatory Notice: ArcticFlow has not been approved, cleared, or certified by the UK MHRA, the EU's notified bodies, the US FDA, or any other medical device regulatory authority. It is not intended to diagnose, monitor, treat, or prevent any medical condition.

ArcticFlow's AI assistant is powered by Claude, developed by Anthropic, PBC. By using the AI features:

• –Anonymised Transmission: Any health context sent to Anthropic's API is anonymised before leaving your device — your name, date of birth, contact details, and other personal identifiers are removed prior to transmission.
• –No Training on Your Data: We have a contractual data processing agreement with Anthropic that expressly prohibits them from using your data to train, fine-tune, or improve their AI models. This is a binding obligation, not a voluntary setting.
• –No Automated Decisions: AI responses are informational suggestions that require your own judgement. ArcticFlow does not make solely automated decisions with significant effects on you.
• –You must not use the AI assistant to seek emergency medical care, crisis support, or as a substitute for professional medical, legal, or financial advice.
• –You must not attempt to misuse, manipulate, or "jailbreak" the AI to produce harmful, illegal, or misleading outputs.
• –ArcticFlow is not responsible for the accuracy, completeness, or appropriateness of AI-generated responses. Use AI insights as a supplementary tool only.

By accepting these Terms, you grant Arctic Flow AI Limited the following limited rights with respect to your data:

• –Service Operation: We may process your data as necessary to operate and improve ArcticFlow as described in our Privacy Policy. The legal bases for processing health data are set out in Section 7 of our Privacy Policy (including explicit consent under Article 9(2)(a) UK GDPR).
• –Anonymised Insights: We may derive anonymised, aggregated, and de-identified insights from usage patterns (not your raw health records) to improve ArcticFlow and develop future health products.
• –No Identifiable Data Sales: We will never sell your personally identifiable health data to third parties for commercial purposes.
• –No AI Training: We will NOT use your raw health records to train any AI model. Our data processing agreement with Anthropic contractually prohibits them from training on your data as well. This applies without exception.
• –Withdrawal: You may withdraw your consent and request deletion of your data at any time by deleting your account or contacting privacy@arcticflow.ai. Withdrawal does not affect the lawfulness of prior processing.

• –Free Tier: Access to core features with limitations as displayed in the App.
• –Paid Subscriptions: Unlock additional features. Subscription fees are charged to your payment method through Stripe or Apple (for App Store purchases). Prices are displayed within the App before purchase.
• –Billing: Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
• –14-Day Cooling-Off Period (UK/EU consumers): As a UK or EU consumer purchasing a subscription, you have a statutory right to cancel within 14 days of purchase without giving a reason (Consumer Contracts Regulations 2013). However, if you request that we begin providing the service immediately — which happens as soon as you access any paid feature after purchase — you acknowledge that you waive this cancellation right for the period of service already consumed. If you wish to exercise your right to cancel before accessing any paid feature, contact support@arcticflow.ai within 14 days of purchase.
• –Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods, except where required by applicable law or where the service has not been provided as described.
• –App Store Subscriptions: For subscriptions purchased through the Apple App Store, Apple manages the subscription lifecycle. To cancel, go to iOS Settings → [your name] → Subscriptions and cancel there. Arctic Flow AI Limited cannot cancel App Store subscriptions on your behalf. Refund requests for App Store purchases must be directed to Apple.
• –Invite Codes: We may issue invite codes for beta access. Invite codes have no monetary value and cannot be transferred for payment.
• –Pricing Changes: We will notify you of price changes at least 30 days in advance. Continued use after the change constitutes acceptance.

• –You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• –You must provide accurate information when creating your account and keep it up to date.
• –You must not share your account with others or create accounts on behalf of others without their consent.
• –Notify us immediately at support@arcticflow.ai if you suspect unauthorised access to your account.
• –You are responsible for all content you enter into ArcticFlow, including health data entered for family profiles.
• –ArcticFlow must not be used for any unlawful purpose or in any way that infringes the rights of others.

You agree not to:

• –Attempt to reverse engineer, decompile, or disassemble the App.
• –Interfere with or disrupt the App's servers, networks, or security systems.
• –Scrape, harvest, or extract data from other users of the App.
• –Use the App to transmit malware, spam, or any harmful code.
• –Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• –Use the App for any commercial purpose without our prior written consent.

We reserve the right to suspend or terminate accounts that violate these terms.

• –ArcticFlow, its logo, name, design, and all associated software and content are the intellectual property of Arctic Flow AI Limited, protected by copyright, trademark, and other applicable laws.
• –Your Data: You retain full ownership of all health data you enter into ArcticFlow. You grant Arctic Flow AI Limited a limited licence to store and process your data solely to provide the services described in these Terms and our Privacy Policy.
• –Feedback: Any feedback or suggestions you provide about ArcticFlow may be used by us to improve the App without any obligation or compensation to you.

To the maximum extent permitted by applicable law:

• –ArcticFlow is provided "as is" and "as available" without additional warranties beyond those implied by law.
• –Arctic Flow AI Limited does not warrant that the App will be error-free, uninterrupted, or secure at all times.
• –Arctic Flow AI Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of health data, arising from your use of ArcticFlow.
• –Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, subject to your statutory rights.
• –Nothing in these Terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded by law.
• –Regulatory Status: ArcticFlow is not a regulated medical device under the UK Medical Devices Regulations 2002, EU MDR 2017/745, or US FDA regulations. It is a personal health information management application only.

To the extent permitted by applicable consumer protection law, you agree to defend, indemnify, and hold harmless Arctic Flow AI Limited, its directors, employees, agents, licensors, and service providers from and against claims, liabilities, damages, losses, costs, or fees (including reasonable legal fees) arising out of or relating to:

• –Your violation of these Terms;
• –Your use or misuse of ArcticFlow;
• –Your violation of any third-party rights, including intellectual property or privacy rights;
• –Any content you submit, post, or transmit through ArcticFlow.

This clause does not apply to the extent that it is unenforceable under the Consumer Rights Act 2015 or any other applicable consumer protection legislation. Your statutory rights as a consumer are not affected.

Arctic Flow AI Limited shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond its reasonable control, including but not limited to acts of God, pandemic, fire, flood, earthquake, war, terrorist acts, civil unrest, government action, industrial disputes, failure of internet or telecommunications infrastructure, or failure of third-party service providers (including Firebase, Anthropic, or Stripe).

In the event of a force majeure event, Arctic Flow AI Limited will use reasonable endeavours to resume performance as soon as practicable.

• –Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Arctic Flow AI Limited regarding the App and supersede all prior agreements.
• –Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force and effect.
• –Waiver: No failure or delay by Arctic Flow AI Limited to exercise any right or remedy provided under these Terms shall constitute a waiver of that or any other right or remedy.
• –Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Arctic Flow AI Limited may assign or transfer its rights and obligations to any affiliate, successor, or acquirer of the business without restriction.
• –Notices: We may provide notices to you via in-app notification, push notification, or to the contact information you have provided. Notices to us must be sent to support@arcticflow.ai.
• –No Partnership: Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Arctic Flow AI Limited.

• –You may stop using ArcticFlow and delete your account at any time.
• –We may suspend or terminate your access to ArcticFlow immediately, without notice, if you breach these Terms or if we are required to do so by law.
• –Upon termination, your right to use ArcticFlow ceases immediately. Sections 2, 4, 8, 9, 10, and 14 survive termination.

• –These Terms are governed by and construed in accordance with the laws of England and Wales.
• –Any disputes arising from these Terms or your use of ArcticFlow shall be subject to the jurisdiction of the courts of England and Wales. If you are a consumer, you may also have the right to bring proceedings in the courts of the country where you are habitually resident.
• –If you are a consumer resident in the EU, you may also have the right to refer a dispute to an online dispute resolution platform (ec.europa.eu/consumers/odr).
• –We encourage you to contact us at support@arcticflow.ai before initiating any formal dispute proceedings. We aim to resolve complaints informally within 30 days.
• –Individual Claims: You agree to bring any claim against Arctic Flow AI Limited in your individual capacity only, and not as part of any group litigation or representative proceeding, to the extent permitted by applicable law and your statutory rights as a consumer.

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notification and update the "Last Updated" date. Where a material change requires fresh consent (including for changes to how we process health data), we will present a new consent request within the App before the change takes effect. If you continue to use ArcticFlow after non-consent changes take effect, you agree to the revised Terms.

For minor changes (e.g., corrections or clarifications), we may update the Terms without direct notification, so please review them periodically.
